State Rep. James DeSana (R-Carleton) today testified before the House Judiciary Committee in support of his plan to repeal Michigan’s red flag law, outlining concerns with the law’s impact on constitutional rights and due process protections.
House Bill 4139 would repeal the Red Flag law enacted during the previous legislative session, which allows courts to issue extreme risk protection orders to confiscate firearms from people and strip them of their Second Amendment rights without due process.
“Michigan’s red flag law undermines due process protections and infringes on the constitutional rights of law-abiding citizens,” said DeSana. “It allows the government to take away someone’s Second Amendment rights without a crime being committed and without the basic guarantees of fairness that every citizen deserves. We should never accept a system where accusations are enough to strip away constitutional freedoms. Public safety matters, but it must be pursued in a way that respects due process, protects individual rights, and upholds the Constitution.”
