Rep. Lucido talks about his HB 4213, which has passed through the House and is currently pending in the Michigan Senate, that amends the Michigan Liquor Control Code of 1998 to state that if a minor does not consent to a preliminary chemical breath analysis requested by a peace officer, the officer cannot administer the analysis without a court order.  The legislation passed the House with broad, bipartisan support, and Rep. Lucido says both federal and Michigan courts have ruled that laws and ordinances requiring a minor to submit to a preliminary breath test are unconstitutional because a PBT is an unreasonable search of a person.
